Help with Separation and Divorce
Marriage
If you are married and are separating, you may be considering divorce as a way of legalising your separation.
You can get divorced in England or Wales if all of the following are true:
- you’ve been married for over a year.
- your marriage is legally recognised in England and Wales (including same-sex marriage).
- England or Wales is your permanent home or the permanent home of your husband or wife, or in some cases, England or Wales has been your permanent home, and you intend that it will be again in the future.
When making an application for divorce, you need only state that your marriage has permanently broken down.

Civil Partnership
You can apply to end (‘dissolve’) your civil partnership if you’ve been in the partnership for over a year. You must state that your civil partnership has permanently broken down. You must fill in a dissolution application which can be found here.
Financial Remedy
You may need to reach an agreement on how the family’s money and property will be divided between you both. You can find more information in our sorting finances section of this website.
